All prices are in euros and include VAT at the rate applicable to EU consumers. Shipping is charged separately and shown before you confirm the order; the rates are on the shipping page.
Deliveries to the United Kingdom, Switzerland and Norway exclude import duty and local VAT, which the carrier collects from you on delivery.
Where a frame is shown at a reduced price alongside a higher one, the higher figure is the price we ourselves charged for that frame in that colour for at least 30 consecutive days in the six months before the reduction. Reductions are made only when a colour is being withdrawn from the range. We do not raise a price in order to show it crossed out.
Your order is an offer to buy. We accept it, and the contract is formed, when we send the dispatch confirmation. Before then we may decline an order — if a size has sold out or a price was listed in error, for example — and refund anything already paid.
Acetate is cut from sheet. Tortoise, marble and other patterned acetates vary from pair to pair, and a frame ordered later may differ in pattern from one ordered earlier or from the photographs. Acetate softens in heat and may need re-adjusting; thin metal frames bend if mishandled; mirror coatings scratch more readily than plain lenses; polarised lenses reduce the visibility of some LCD screens. These are properties of the materials, described on the site and on each product page, and are not defects.
Payment is collected at checkout by our payment provider. We never receive or store full card numbers.
Delivery times are estimates in working days. Risk passes to you when the parcel is delivered. If a parcel goes missing, tell us and we will pursue the carrier and either resend or refund.
As a consumer you may withdraw from the contract within 14 days of receiving the goods without giving a reason. We extend that to 30 days. Frames must be unworn, unscratched and returned in their case with the cloth; cloths and pouches must be unopened. Return postage is yours to pay unless the item was faulty or not what you ordered. We refund within 14 days of the goods reaching us, to the original payment method.
Under EU and Italian law (Codice del Consumo) you have a two-year right to goods that conform to the contract. Separately and in addition, we guarantee the hinges and the lens coatings of every frame for 2 years from purchase, repairing or replacing at our cost including postage. The guarantee does not cover scratches from use, loosening of acetate through heat, bent metal, chipped acetate, worn plating, perished silicone parts or loss. Full details are on the shipping and returns page. Neither guarantee limits your statutory rights.
Every lens sold on this site is marked UV400 and carries its tint category on the product page and inside the temple. Category 4 lenses are not suitable for driving, and no sunglass lens is suitable for looking directly at the sun or for use during an eclipse. Our sunglasses are not safety eyewear and are not a substitute for it.
The text, photographs, frame designs and product names on this site are ours. Every frame is made to our own patterns and specification, under our own name only. We do not make, sell or imitate other companies’ designs or trade marks; we do not use other companies’ model names, logos or markings, on the frames or in our descriptions; and nothing on this site is offered as a version, replica or equivalent of another brand’s product. Shape names used here — square, round, pilot, cat-eye, oversized, sport — are generic descriptions of form.
We are liable for foreseeable loss caused by our breach of these terms. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot lawfully be excluded under Italian law. We are not liable for indirect or consequential loss.
Write to hello@shadeandsiesta.com. We acknowledge within 2 working days and aim to resolve within 14. If we cannot agree, you may use the European Commission’s online dispute resolution platform or an Italian consumer conciliation body.
Italian law governs these terms and the Italian courts have jurisdiction. This does not remove the protection of the mandatory consumer law of the country you live in.
